Exempt or Non-Exempt? Applying the FLSA White Collar Rules to the Construction Industry

On August 23, starting at 2:00 p.m. EDT, AGC of America will conduct an audio conference called “Exempt or Non-Exempt?  Applying the FLSA’s White Collar Rules in the Construction Industry.”  Make sure that your HR staff is aware of this important educational opportunity.

Construction employers have long struggled with applying exemptions to the federal Fair Labor Standards Act’s overtime pay and minimum wage requirements, and sweeping changes to the regulations issued in 2004 have created new uncertainties.  With collective lawsuits on the rise and the potential for debilitating penalties for misclassification, employers are well-advised to examine their practices to ensure compliance.

During this 90-minute audio conference, employment lawyer John E. Thompson will explain the requirements of the so-called “white collar” employee exemptions – including the executive, administrative, professional, outside sales, computer employee, and highly-compensated employee exemptions – and will specifically address how they apply to the particular job classifications most troublesome for construction employers.  Time will be provided for questions and answers.
