Annual DGA Opt-Out Deadline - January 20th

Reminder: The deadline for opting out of the annual presumed salary basis for Principal Directors is approaching.

Pursuant to the AICP collective bargaining agreement with the DGA, Pension and Health contributions on behalf of Principal Directors are based on a presumed salary. Also in the agreement is an annual “opt-out” provision that allows a company to make contributions on behalf of a Principal Director based on actual earnings should they believe that arrangement is beneficial to their particular situation.

NLRB Postpones Notice-Posting Rule
The National Labor Relations Board has agreed to postpone the effective date of its employee rights notice-posting rule at the request of the federal court in Washington, DC hearing a legal challenge regarding the rule. The Board’s ruling states that it has determined that postponing the effective date of the rule would facilitate the resolution of the legal challenges that have been filed with respect to the rule. The new implementation date is April 30, 2012.

California Wage Theft Prevention Act

Last fall, AICP’s Legal Counsel, Kane Kessler, issued a memo to the AICP membership regarding California Labor Code, California Senate Bill 459 and Assembly Bill 469. (Please click here to view the full memo.) Per Assembly Bill 469, California has amended Labor Code Section 2810.5 to add wage rate and overtime rate notice requirements similar to the recently enacted New York Wage Theft Prevention Act ("WTPA"). The California WTPA amends several Labor Code Sections to include payment and notification requirements and enforcement procedures — IT WENT INTO EFFECT JANUARY 1, 2012. Read More
