IBWA Maintains Opposition to
Baltimore Beverage Container Tax
As previously reported in IBWA News Splash (CLICK HERE to read), the Baltimore beverage container tax proposal (Legislative File 10-0474) passed the Baltimore City Council Taxation, Finance, and Economic Development Committee on May 2, 2010, after which it was sent to the full City Council for its consideration. After stalling for nearly six weeks, the full City Council finally took a vote on the measure on June 17, and it failed to pass.
LF 10-0474 in its original form would have imposed an excise tax of .04 cents per container on distributors who supply beverages—including bottled water—in non-reusable containers under 2 liters in size. Dairy products, nondairy milk-substitute products, and any beverage containing at least 10 percent natural fruit juices would be exempt from the provisions of the bill.
After failing to pass LF10-0474, Council Member Helen Holton made a motion to reconsider the bill on June 21, and offered an amendment to impose a tax of .02 cents per container on distributers who supply beverages—including bottled water—in non-reusable containers under 2 liters.
The same day the full City Council advanced the legislation to a third reading for final passage to be voted on June 24, 2010.
IBWA has continued to work with industry allies to maintain opposition to the beverage container tax. In addition to those efforts, an IBWA action alert was sent to Bottled Water Matters signatories in Baltimore this week asking them to reach out to their City Council Members as soon as possible to encourage them to vote against the .02 cents per container tax.

BIFs to IBWA Past Due
IBWA’s 2010 plant inspection program has begun. The program is designed to assist bottlers in determining how well their bottling operation complies with all applicable federal and state regulations, as well as IBWA Bottled Water Code of Practice requirements for bottled water production and sale. In 2010, annual plant inspections again are based on conformance with a bottling plant’s HACCP plan as well as FDA- and IBWA-mandated good manufacturing practices (GMP) requirements.
The 2010 IBWA membership renewal materials, which include a copy of the two-page Bottler Information Form (BIF), have been mailed to all IBWA members. IBWA Bottler members should complete the BIF form and fax it to IBWA's Technical Programs Coordinator Dimeko Shaw at IBWA at 703.683.4074. (CLICK HERE for a copy of the BIF form.) To facilitate the scheduling of your inspection, we had previously requested that you return this form to IBWA immediately. If you operate more than one bottling facility, please duplicate the form and return one form for each plant. If a form is not received for each plant, the audit contractor may not be able to schedule the necessary inspections in 2010.
Please note also that inspection fees may be based on the date the BIF is received by IBWA. BIFS were due by May 15, 2010. If your BIF is received after May 15, 2010, you may be responsible for paying a surcharge. (Your annual IBWA membership dues amount does not include the cost of your plant inspection.)

A Healthy Perspective on BPA
Canada’s Financial Post recently published an article supportive of bisphenol-A (BPA) by Julie E. Goodman, an adjunct professor at the Harvard School of Public Health and a research scientist who has conducted studies of BPA at low-levels. Her conclusions: BPA has been demonstrated to be safe. Substituting less studied materials for BPA could be dangerous. CLICK HERE to read.
