Nondiscrimination rule summary and resources
(NF, HHA)

The HHS' Nondiscrimination in Health Programs and Activities rule, published in the Federal Register on May 18, 2016, prohibits discrimination based on race, color, national origin, age or disability in federally funded health programs. People with disabilities or limited English proficiency are also protected by the rule. IHCA Legal Consultants at Davis Brown Law, have prepared a summary of the rule for our members.

The rule expands Title IX protections to include discrimination of sex, gender identity, pregnancy and sex stereotyping. For a training resource, see the IHCA Bulletin article, Free training on LGBT needs and rights in care settings.

One of the key provisions of the rule is posting nondiscrimination notices in your state’s top 15 non-English languages in your facility, on your facility’s website, and in “significant communications and publications” by Oct. 15, 2016. The HHS, Office of Civil Rights, has posted a list of the top 15 languages spoken by individuals with limited English proficiency (LEP) in each state and territory. This list was created for covered entities use in identifying languages to provide translated taglines in implementing the final nondiscrimination rule, Section 92.8(d)(1)-(2).

The majority of the rule's provisions became effective starting July 18, 2016. It applies to most healthcare programs including home health care services, nursing care facilities, ID/DD residential facilities, as well as, hospitals and doctor offices.
