DHS plan for HCBS settings final rule requirements
(HCBS providers)

The Iowa DHS HCBS Statewide Transition Plan has been approved by CMS. As part of the Iowa HCBS stakeholder group, ICAL has offered our members' feedback and assisted in the process of determining which HCBS services are provided in non-institutional settings and extending the compliance date for providers from 2019 to 2022.

The overall goal is that HCBS services are provided in settings that are integrated, community-based settings that support full access of individuals receiving Medicaid as any other person not on Medicaid. The settings are to optimize individual initiative, autonomy and independence in making choices.

DHS is responsible for ensuring that Iowa's HCBS providers are meeting the new CMS final settings rules. In the updated Iowa code (441—77.25(249A) Home- and community-based habilitation services), DHS indicates it will conduct annual reviews of the HCBS Provider Self Assessments. The HCBS Quality Oversight Unit may require the provider to submit a “corrective action plan (CAP)” for those areas where the provider may not be meeting the CMS settings rules. The CAP must detail the provider’s plan to remediate and come into compliance with the CMS settings rule. Each CAP must include specific timelines for compliance and the provider’s monitoring process to be used to ensure milestones and timelines are met.

Residential settings that are provider owned/operated, such as assisted living programs and residential care facilities, will have until 2022 to be in compliance with the HCBS settings rules. Also see additional resource under Information Resources on the on the DHS HCBS Settings Transition webpage
