POLITICAL PULSE: Appropriations Committee Reaches Majority Budget; Continues to Negotiate with House Republicans
The Legislature's Appropriations & Financial Affairs Committee met late into the evening last Friday night and voted 9-4 in favor of a committee amendment on L.D. 1019, the biennial budget for State Fiscal Years 2016-2017 that begins on July 1, 2015. The MMA's budget priorities, including the ACA primary care fee increase and avoidance of various cuts, appear to be protected in this majority report. The partisan composition of the House is 78 Democrats, 68 Republicans, 4 Independents, and 1 Unenrolled. With this composition, reaching a 2/3 vote to enact the budget on an emergency basis so it becomes effective immediately and to overturn an anticipated gubernatorial veto, would be impossible without some Republican votes. So, the Appropriations Committee and legislative leadership continue to negotiate aspects of the budget with House Republican members of the committee.
LEGISLATIVE BUSINESS SHIFTS FROM COMMITTEE TO FLOOR
The 127th Maine Legislature has reached the point of its First Regular Session when the joint standing committees have completed their work on bills assigned to them (except for the Appropriations Committee as noted in the lead article) and have reported those bills out. Bills voted unanimously, either "ought to pass" or "ought not to pass," will receive their several readings on the floor of the House and Senate, but will not be debated. Divided committee reports start piling up on the House and Senate calendars and legislative leadership plan caucuses and debates on those divided reports. MMA will send legislative alerts advising physicians how they can influence floor debate, should they wish to do so.

SENATE ACTION LATE TODAY ON CRNA AND LYME BILLS
In Senate action late this afternoon, MMA witnessed emotion winning out over science and patient safety in the debate on these bills. The vote was 10-25 in favor of the minority "ought to pass as amended" report, preferred by MMA, on LD 422, the Lyme bill. After the failure of that motion, the Senate went on to pass the majority "ought to pass as amended" report which was based on Massachusetts law on the topic. Then the Senate took up the bill to allow CRNAs to prescribe independently and voted 18-17 in favor of the minority "ought to pass as amended" report. At this hour, the MMA staff still is working with Maine Society of Anesthesiologists and Spectrum representatives to counter this vote.

AMA 2015 Annual Meeting Convenes
The 2015 Annual Meeting of the American Medical Association convened in Chicago on Saturday, June 6th and is scheduled to adjourn Wednesday morning. During the four day meeting, members of the House of Delegates will discuss hundreds of resolutions and reports sponsored by state and national medical organizations. Maine has two physician delegates to the House, Richard Evans, M.D., a surgeon from Dover-Foxcroft, and Maroulla Gleaton, M.D., an ophthalmologist practicing in Augusta. MMA President Lisa Ryan, D.O. and EVP Gordon Smith, Esq. are also in attendance.
Some of the more significant items being discussed include the Medicare payment system post SGR, Maintenance of Certification and Maintenance of Licensure, which seem to become more controversial every year and rising generic drug prices. Watch future issues of this Maine Medicine Weekly Update for the results of these discussions.

On August 7, 2014, the President and
Congress enacted the Veterans Access, Choice, and Accountability Act of 2014,
which established the Veterans Choice Program (Choice) to improve access to
care for our nation’s Veterans by allowing Veterans who qualify for this
program to receive health care in their communities rather than waiting for a
Department of Veterans Affairs (VA) appointment or traveling to a VA facility.
VA is pleased to let you know that
we have partnered with Health Net Federal Services to serve Veterans who
qualify for the Choice program. Health
Net is working with providers to establish network capacity to provide eligible
Veterans access to covered medical care when the local VA medical facility
cannot readily provide the care due to lack of available specialists, long wait
times, geographic inaccessibility, or other factors.
I realize that you provide non-VA
medical care to Veterans through programs other than our Choice network
arrangement with Health Net and I greatly appreciate your willingness to
provide medical services to our nation’s Veterans. Moving forward, VA asks you to join the
Health Net network to continue to provide services covered under the Choice
Act. In the future these networks will
be the primary vehicle through which VA will authorize and pay for care for
services covered under Choice.
Reimbursement for medical services provided under
the Choice program is 100% of Medicare rates. Claims and reimbursement are
handled by Health Net and will be processed within 30 calendar days of receipt
of claim and medical documentation per the agreement.

CMS Releases PQRS Payment Adjustment Data, Strategic Vision
A strategic vision from the Centers for Medicare & Medicaid Services (CMS) describes a long-term vision for the agency's physician quality reporting programs. The document emphasizes alignment among CMS' various quality programs and acknowledges challenges with moving to CMS' desired future.
The agency released the document around the same time as it released statistics on the 2015 Physician Quality Reporting System (PQRS) payment adjustment. Based on 2013 PQRS reporting, 469,755 physicians are subject to a reduction of 1.5 percent of their 2015 Part B Medicare Physician Fee Schedule allowed charges.
Here's a breakdown of the data:
- The majority of physicians who did not successfully participate in 2013 PQRS did not attempt to participate in PQRS.
- Just below 2 percent of physicians did attempt to participate, but they were not successful because they submitted only invalid quality data codes.
- The registry and electronic health record reporting options continue to grow in popularity.
The AMA will continue to advocate for making the PQRS program more meaningful to physicians and patients, as well as ensuring that all physicians can successfully participate in the program and avoid a penalty.

Changes Physicians Should Know in the SGR Repeal Law
When the Medicare Access and CHIP Reauthorization Act of 2015 (MACRA) was signed into law in April, it didn't just repeal the Medicare sustainable growth rate (SGR) formula that had been plaguing physicians for nearly two decades. The bill contained other provisions that will impact how physicians deliver care now and in the future.
Here are several provisions that should be beneficial for physicians:
Medicare payment rates will be stable.
MACRA prevented an impending physician payment cut under the SGR and increased the Medicare conversion factor, part of the formula for calculating physician payments. As a result, Medicare physician pay this year will be 27 percent greater than under SGR.
The bill also provides for positive payment updates of 0.5 percent, starting July 1 this year and then on January 1 annually through 2019. Over the next decade, MACRA is projected to increase Medicare funding for physician services by roughly $150 billion.
Quality reporting programs will be consolidated.
Medicare's current quality reporting programs will be simplified into one merit-based incentive payment system, referred to as "MIPS." This means the current web of penalties under the Physician Quality Reporting System (PQRS), meaningful use electronic health record (EHR) program and the value-based payment modifier will expire at the end of 2018 and will be replaced with the MIPS.
Beginning in 2019, physicians who score well in the MIPS could receive substantial bonuses.
Performance under the MIPS will be based upon four categories—quality, resource use, meaningful use and clinical practice improvement activities. The MIPS also would build and improve upon current quality measures and concepts in existing programs.
Physicians will be encouraged to report quality measures through certified EHR technology or qualified clinical data registries. Participation in a qualified clinical data registry would also count as a clinical practice improvement activity.
Alternative payment models will be rewarded.
Physicians who participate in qualified alternative payment models will receive a 5 percent bonus starting in 2019. These physicians also will be exempt from participating in MIPS. Technical support will be provided to help smaller practices participate in alternative payment models.
The AMA is engaging with medical specialty societies and other organizations to help develop and get payers to support implementation of physician-designed alternative payment models. Results from a recent AMA study conducted by the RAND Corporation found that doctors want to improve patient care delivery through new payment models but need help successfully managing the transition. That includes being able to resolve the diverse priorities and quality metrics of different payers and securing more timely and accurate clinical data to ensure long-term success.

Physicians will have liability protections.
The bill contains a provision similar to the Standard of Care Protection Act that will protect physicians by preventing quality program standards and measures (such as PQRS or MIPS) from being used as a standard or duty of care in medical liability cases.

A new interest group has recently formed
called the Maine Independent Physicians. The group is made up of primary care physicians who are practicing independently in the state. The purpose of their meetings is
to discuss common issues and to have a voice on a variety of subjects.

Medicine practice located in Oakland, Maine, is recruiting for an experienced
Family Medicine Physician to join our growing team. Responsible for providing
care for pediatric through adult patients while working in collaboration with
our practice administrator, providers and senior management team as Oakland
continues the transition to Patient Centered Medical Home. Join our team of
four family medicine physicians and one physician assistant and collaborate
with a unique mix of seasoned physicians who have practiced in the area over 10

will be 32 hours of patient contact time and up to 8 hours of administrative

Emergency Room Position at Sebasticook Valley Health in Central Maine
Sebasticook Valley Hospital is a 25-bed modern critical access hospital located in Pittsfield which is 20 minutes north of Waterville, home of Colby College, and 45 minutes south of Bangor, Maine’s second largest city. The hospital serves a population of 30,000 in this central Maine area of beautiful rolling hills. The ER is staffed by an Emergency Medicine trained Director and three other physicians. This is an experienced staff. ER volume is 15,000. Physicians have a flexible schedule working 12 `hr shifts. We are seeking either an emergency residency trained physician, can be resident, or board certified FP with ED experience. The hospital has EMR, and is CPOE. The compensation and fringe benefits package is highly competitive. Sebasticook Valley is an affiliate of Eastern Maine Medical Center, the tertiary care center in Bangor.
