Consumer and Healthcare Groups File Suit for Medicaid Expansion Implementation

On April 30, 2018, Maine Equal Justice Partners (MEJP) held a press conference announcing they have filed a lawsuit in Maine Superior Court to require implementation of Medicaid expansion as enacted by Maine voters in a 2017 referendum.

 

Robyn Merrill, Executive Director of MEJP, announced the action against the Maine Department of Health and Human Services by MEJP, Consumers for Affordable Health Care, the Maine Primary Care Association, Penobscot Community Health Care, and several individual plaintiffs who would be eligible for coverage under the expanded form of Medicaid. The claim is based on “a simple legal issue,” said Jamie Kilbreth, Esq., lead plaintiffs’ attorney on the case: the State’s failure to file a State Plan Amendment by April 3, 2018, as required by the referendum.

Ms. Merrill stated that the plaintiffs had waited for the Legislature or the Governor to act on the issue, “but we couldn’t wait any longer.”

Governor LePage’s office stated that he can’t comment on “active litigation.”
