Maine Medical Association Zoom Meeting for Providers During COVID-19 Pandemic
In the interest of continuing to promote the health, well-being & effectiveness of physicians on the front line during the COVID-19 pandemic MMA will continue these weekly calls until they are no longer needed. We sincerely hope you can join us again, or for the first time.
We would like to thank the 25+ physicians that joined our first
Zoom meeting, Tuesday night, April 7th. There were heartfelt
exchanges recognizing the uncertainty, anxiety and sheer pressure you’re facing
every day and we want you to know in no uncertain terms that we are here to
support you. In the interest of continuing to promote the health,
well-being & effectiveness of physicians on the front line during the COVID-19
pandemic we want to continue these weekly calls.
We will again host a virtual discussion next Tuesday, the 14th, from 6-7:30
(or as along as it takes). You can Zoom or dial-in at any time during the
meeting and leave when you want. The intent is not a clinical discussion but, if it goes that way, so be it. Instead, perhaps you want to simply
commiserate and empathize with your fellow physicians during this
difficult and trying time
There were a few logistical things to consider from our first
experience. Due to the proliferation of what is called, “Zoom bombing” Zoom has
instituted a password mechanism for meeting security. While we didn’t have an

There is so much misinformation being spread about the novel coronavirus it’s causing people to either panic or blatantly ignore the dangers. People are making bad decisions and some of your patients are confused. You can help your patients and loved ones take on that information.
There is so much misinformation being spread about the novel coronavirus it’s causing people to either panic or blatantly ignore the dangers. People are making bad decisions and some of your patients are confused.
You can help your patients and
loved ones take on that information.
The virus has not been contained
and we are still working to flatten the curve. We have taken positive steps
through quarantine directives and we at the MMA would like to applaud our state
public health experts for their sound direction.
The news cycle is a constant flow
of grim statistics, predictions of death, and buzzworthy story titles that are
more likely to incite panic and cause people to excessively worry. Media looks
for linear explanations, which don’t exist right now. In interviews, experts
are asked to distill complicated knowledge into succinct one-line answers, and
in some cases are asked for a yes or no answer. In addition, there’s no
shortage of experts expressing opinions and they too are oftentimes uncertain,
and in conflict with their predictions. In
the end, media customarily reduces the issue to easily consumable data of a
“total” cases-and-deaths ticker stamped on the screen/page. Scary,
worst-case-scenario numbers tend disproportionately drive headlines. The flip
side is when they offer up unwarranted mentions to unproven supposed
'treatments' or purely anecdotal new symptoms.
One suggestion is to recommend watching or listening to the daily updates by Dr. Nirav Shah, director of the Maine Center for Disease Control and Prevention and, especially, avoid national broadcast networks regardless of political affiliation/ideology. Dr. Shah provides the perfect balance of fact, science, caution and empathy with a Maine focus. Not only that, Maine media has proven to effectively capture the essence of what your neighbors are thinking when presenting their questions. We thank them for that.

New DEA Buprenorphine Guidance
The U.S. Drug Enforcement Administration (DEA) has issued guidance to DEA-registered physicians providing new flexibility for physicians managing patients with opioid use disorder.

The U.S. Drug Enforcement Administration (DEA) late yesterday issued guidance to DEA-registered physicians providingnew flexibility for physicians managing patients with opioid use disorder. The new guidance permits physicians and other health professionals
with a waiver allowing them to prescribe buprenorphine
for the treatment of opioid use disorder to issue these prescriptions
to new and existing patients based on an evaluation via telephone. The new policy is effective from March 31 for the duration of the COVID-19 emergency.

AMA released a statement applauding these actions, which include Medicare coverage
for telephone services, significant additions to the list of covered telehealth
services such as emergency visits, and greater clarity on the use of remote
patient monitoring for acute conditions like the novel coronavirus. Below are

Under the President’s leadership,
the Centers for Medicare & Medicaid Services (CMS) is announcing an
expansion of its accelerated and advance payment program for Medicare
participating health care providers and suppliers, to ensure they have the
resources needed to combat the 2019 Novel Coronavirus (COVID-19). This program
expansion, which includes changes from the recently enacted Coronavirus Aid,
Relief, and Economic Security (CARES) Act, is one way that CMS is working to
lessen the financial hardships of providers facing extraordinary challenges
related to the COVID-19 pandemic, and ensures the nation’s providers can focus
on patient care. There has been significant disruption to the healthcare
industry, with providers being asked to delay non-essential surgeries and
procedures, other healthcare staff unable to work due to childcare demands, and
disruption to billing, among the challenges related to the pandemic.
“With our nation’s health care
providers on the front lines in the fight against COVID-19, dollars and cents
shouldn’t be adding to their worries,” said CMS Administrator Seema Verma.
“Unfortunately, the major disruptions to the healthcare system caused by
COVID-19 are a significant financial burden on providers. Today’s action will
ensure that they have the resources they need to maintain their all-important focus
on patient care during the pandemic.”
Medicare provides coverage for 37.4
million beneficiaries in its Fee for Service (FFS) program, and made $414.7
billion in direct payments to providers during 2019. This effort is part
of the Trump Administration’s White House Coronavirus Task Force effort to
combat the spread of COVID-19 through a whole-of-America approach, with a focus
on strengthening and leveraging public-private relationships.
Accelerated and advance Medicare
payments provide emergency funding and addresses cash flow issues based on
historical payments when there is disruption in claims submission and/or claims
processing. These expedited payments are typically offered in natural disasters
to accelerate cash flow to the impacted health care providers and suppliers. In
this situation, CMS is expanding the program for all Medicare providers
throughout the country during the public health emergency related to
COVID-19. The payments can be requested by hospitals, doctors, durable
medical equipment suppliers and other Medicare Part A and Part B providers and
suppliers.
To qualify for accelerated or
advance payments, the provider or supplier must:
- Have billed Medicare for claims
within 180 days immediately prior to the date of signature on the provider’s/
supplier’s request form,
- Not be in bankruptcy,
- Not be under active medical
review or program integrity investigation, and
- Not have any outstanding
delinquent Medicare overpayments.
Medicare will start accepting and
processing the Accelerated/Advance Payment Requests immediately. CMS
anticipates that the payments will be issued within seven days of the
provider’s request.

The Maine Responds Emergency Health Volunteer System is the online registration system for public health, healthcare and emergency response volunteers for the State of Maine.
Maine Responds is a partnership that integrates local, regional, and statewide volunteer resources to assist our public health and healthcare systems. It is part of a national initiative to train, coordinate, and mobilize volunteers during an emergency. Maine Responds coordinates verified, pre-credentialed public health, healthcare and emergency response volunteers into a single database that can coordinate the need for volunteers across county, regional and state lines if needed.

Nominations for the MMA 2020 Mary Cushman Award for Humanitarian Service
Presented each year by the Maine Medical Association to recognize the humanitarian service of medical volunteers who serve in Maine, the US or abroad.
The Maine Medical Association presents the Mary F. Cushman, MD Award for Exceptional Humanitarian Service as a Medical Volunteer each year. The award was established in 2003 in recognition of the MMA's 150th anniversary.
Priority consideration is given to:
- the nomination of a Maine physician who is a member of the Maine Medical Association
- nominations submitted by members of the Maine Medical Association
- nominations that, for international volunteering, include training people in other countries to provide care in their own communities.
Nominations for the 2020 Mary Cushman Award are due by July 31, 2020. The award is announced at the MMA's Annual Session in
September and includes a $1,000 donation to the institution or
organization of the recipient's choice.

Information about the 2020 Census
The census is a count of every person who lives in the US and its
territories, and it happens every 10 years. In 2020 every household in
America will receive a notice to complete the census to count everyone
who lives in your home as of April 1, 2020.

Health care providers have a unique opportunity to remind their patients about the importance of the census. All responses will inform where funding is distributed each year to communities nationwide for clinics, schools, roads and more. In 2016 $4.1 billion of federal funding was allocated to Maine based on census data. Each person not counted is a loss of $15,000-$20,000 of federal funds lost to Maine over the course of 10 years. Children under the age of 5 are the group most commonly undercounted.
Invitations to respond to the 2020 Census were delivered in March. The
public is encouraged to respond to the 2020 Census online at my2020census.gov, over the phone or by paper form, if they receive one.
Responses to the 2020 Census are safe, secure, protected by federal law,
and answers can only be used to produce statistics. For more

New Law Takes Effect Concerning Physician Assistant Scope of Practice
LD 1660, An Act To Improve Access to Physician Assistant Care, was signed into law by Governor Mills on March 18. Because it was amended by the Legislature as an emergency law consistent with legislative rules in response to the COVID-19 pandemic, the law was effective the day it was signed.

New Law Takes Effect Concerning Physician Assistant Scope of Practice
LD 1660, An Act To Improve Access to Physician Assistant Care, was
signed into law by Governor Mills on March 18. Because it was amended by the
Legislature as an emergency law consistent with legislative rules in response
to the COVID-19 pandemic, the law was effective the day it was signed.
What The New Law Does
Eliminates the requirement that physician assistants render care under
the supervision and control of a physician and by extension any ‘plan of
supervision.’
Eliminates the requirement that physician assistants complete a
training program approved by the licensing board(s)
While physician assistants will still be required to be licensed, the
new law eliminates the registration requirement. Licensure can still be
obtained by the physician assistants’ choice of licensing boards.
Allows physician assistants to delegate “certain activities relating to
medical care and treatment” to the “physician assistants employees, support
staff or members of the health care team” and accepts liability for delegation.
The Board of Osteopathic Licensure and the Board of Licensure in
Medicine will jointly adopt rules for the licensure and practice of physician
assistants. Rules may include but are not limited to:
Education requirements
Requirement for collaborative agreements and
practice agreements (*replaces a written plans of supervision)
Scope of Practice
Physician assistants “may provide any medical service” as “prepared by
their education, training and experience and is competent to perform.” The
scope is to be determined by practice setting and includes hospitals, physician employers “or
an independent practice setting” among others with a system of credentialing
and granting of privileges.
Collaborative Agreements
For physician assistants with LESS than 4,000 hours of documented
clinical practice
Collaborative agreement is defined as a document agreed to by a
physician assistant and a physician that describes the scope of practice as
determined by the practice setting and describes the decision-making process
for a health care team including communication and consultation among health
care team members. A “health care team” and ‘may’ include a physician. Other
professions listed are, APRN, physical therapist, occupational therapist,
speech therapist, social worker, nutritionist, psychotherapist, counselor, or
other licensed professional.
Physician assistants with less than 4,000 hours of practice must work
under a collaborative agreement. They may, however, used a system of
credentialing and granting of privileges and scope of practice agreement from a
health care facility in place of a formal individual collaborative agreement.
The collaborative agreement, or scope of practice agreement must be
sent to the Board of Osteopathic Medicine or Board of Licensure in Medicine for
approval.
(Note: while the agreement needs to be between the PA and physician,
there’s no requirement that the decision-making process, communication or
consultation needs to be with a physician, although the physician has ultimate
control over that process through development of the collaborative agreement).
Practice Agreement
For physician assistants with MORE than 4,000 hours of documented
clinical practice
Defined as, “a document agreed to by a physician assistant who is the principal
clinical provider in a practice and a physician that states the
physician will be available for collaboration or consultation.” (emphasis MMA).
Physician assistants may be the principal clinical provider in a
practice without a physician partner but must have a
practice agreement with a physician, “and other health professionals as
necessary,” that describes the physician assistant’s scope of practice. The practice
agreement must be approved by the Board of Osteopathic Medicine or Board of
Licensure in Medicine. (emphasis MMA).
A special paragraph in the law states the sections covering scope of
practice, consultation, collaborative agreements and practice agreements “must
be liberally construed” to authorize physician assistants to work at
the full extent of their education, training and experience in accordance with
their scope of practice as determined by their practice setting. (emphasis
MMA).
Consultation
A physician assistant SHALL consult, with, collaborate with, or refer
the patient to an appropriate physician or ‘other health care professional’ when indicated by consideration of a patient’s
condition along with the education, competencies and experience of the physician
assistant, and standard of care. The level of consultation will be determined
by the practice setting. The law does require that a physician must always be
available to a physician assistant for
consultation.
(Note:
According to this definition the consult could be with another physician
assistant as defined by ‘health care professional’ and ‘practice setting’
includes ‘private practice.’ The law does not prohibit physician assistants
from opening their own private practice.)
Prescriptive Authority
Allows physician assistants to prescribe schedule II through schedule V
and will be allowed to dispense prescription or legend drugs only when a
pharmacy service isn’t available, it’s in the best interests of the patient or
in an emergency.
Miscellaneous Provisons
Physician assistants are considered primary care providers and/or
medical practitioners and/or health care professionals under:
managed care health insurance plans,
laws concerning drawing blood specimens to
determine OUI,
probate court guardianship matters,
expediated partner therapy,
minors and abortions,
employee substance use testing,
provision of care concurrent with emergency
medical services
One physician assistant will be added to the Board of Osteopathic
Licensure AND the Board of Licensure in Medicine.

MMA Legislative Calls are POSTPONED
The Tuesday evening Legislative Calls hosted by MMA will be postponed until further notice.
In response to the rapidly changing health crisis the Presiding Officers of the Maine Legislature late last week cancelled all committee meetings, including public hearings, work sessions and confirmation hearings for the rest of the session. The one exception was the Appropriations Committee, for various budgetary matters and work related to the Governor’s Supplemental Budget. It was also announced the Legislature would meet one more day to consider bills “directly related to coronavirus response and other critical services, then adjourn.” The Capitol was then closed to the public, with only legislators, staff and media members allowed in the building while lawmakers worked. All bills still not acted upon or under consideration will remain active until the Legislature reconvenes.
Governor Janet Mills issued a proclamation
of civil emergency Sunday to help
the state cope with the growing outbreak of COVID-19 just days after the Legislature’s
announcement.

Building Hope Across Populations-Beyond the Basics in Suicide Prevention RESCHEDULED

The Building Hope Across Populations 2020 - Beyond the Basics in Suicide Prevention conference at the Augusta Civic Center scheduled for April 10th has been rescheduled and will be held on Thursday, October 1, 2020.

Since its inception in 2003, Maine's annual Beyond the Basics in Suicide Prevention Conference has provided Maine health professionals, educators, clinicians, first responders, and community members with best practice information, guidance and resources in suicide prevention and management efforts. The conference is designed for an adult audience that has attained basic training and knowledge in suicide and suicide prevention, and wishes to deepen their understanding of prevention and expand their skills set.
Our theme for the 2020 conference is Building Hope Across Populations, and will include a range of informative breakout sessions centered on how to serve Maine's at-risk, diverse, and growing populations.
This year's conference features national experts on inclusive suicide prevention strategies, as well as local community members, professionals, and clinicians who will address suicide prevention, intervention, and post-vention issues. The program will offer messages of hope and recognize caring citizens who have made a difference in the lives of at-risk Mainers. Featuring keynote speaker Anneliese Singh.

Partners for World Health (PWH) is a non-profit 501(c)3
based in Portland, Maine committed to reducing medical waste, improving the
quality of healthcare in underserved countries, and educating our local
community about global healthcare issues.
Our mission is to collect unused/discarded medical supplies
from local medical facilities and to distribute those medical supplies to
international communities in need. This work limits the negative impact we
have on the environment and provides much-needed resources to the
developing world. To support our work in improving health
conditions around the world, we send local medical personnel on medical
missions to developing countries, and we educate our local Maine community
about global health issues.
PWH has a great need for advice from certain medical
professionals on how to sort and package the vast amount of supplies received,
for shipping and use in destination countries, specifically, in the areas of:

- Respiratory: any and all aspects
