NADA Supports Revised LaTourette Amendment to Restore Dealer Rights

WASHINGTON -- The National Automobile Dealers Association’s work with the House leadership and the House Judiciary Committee intensified over the weekend to develop revisions to an amendment, sponsored by Rep. Steve LaTourette, R-Ohio, on the Financial Services appropriations bill. The revisions reflect the goals pursued by NADA for the past several months on dealer rights. 

NADA supports this approach unless GM and Chrysler agree to an alternative that addresses dealer concerns. The revised amendment would give affected dealers transparency and the right to arbitrate. The arbitrator would balance the interests of the dealer, the manufacturer and the general public. Regrettably, the revised amendment would not provide compensation for affected dealers. 

The revised LaTourette amendment is part of the final negotiations on a year-end spending bill necessary to keep the government operating. These leadership-driven negotiations on the broader bill will occur during the next few days. The language could be accepted, rejected or modified. NADA is working aggressively with all parties to achieve a meaningful opportunity for dealer reinstatements.

House Likely to Move on Regulatory Reform by End of the Week

President Barack Obama this week will likely see Congress take a major step forward in accomplishing a sweeping financial regulatory overhaul. The full House is expected to vote by Friday on a wide-ranging package to regulate risks across the financial system, impose new curbs on the multi-trillion dollar derivatives market and give the government tools to dissolve failing financial firms. House Financial Services Committee Chairman Rep. Barney Frank, D-Mass., and House Energy & Commerce Committee Chairman Henry Waxman, D-Calif., were also working out a deal on the leadership structure of the new Consumer Financial Protection Agency (CFPA). Frank favors having a single director, while Waxman wants a series of commissioners appointed to staggered terms. Auto dealers are also working to maintain language in the bill that exempts them from the CFPA, while including auto loan financing.

Editor's note: Since the Committee vote in late October, NADA has been working in good faith with Committee members to ensure that the Campbell amendment is limited in scope to only exempt auto dealers from CFPA. Regardless, some House members are seeking to make changes to the amendment that would render it ineffective by including all auto financing under the new agency’s jurisdiction. Dealers should be on notice that grassroots involvement will likely be necessary to prevent the Campbell Amendment from being overturned.

EPA to Call Greenhouse Gases a Danger to Public Health

WASHINGTON -- The Environmental Protection Agency will declare carbon dioxide and other greenhouse gases a danger to public health coming more than two years after the Supreme Court gave it authority to regulate them. The announcement to be made this afternoon comes as the United Nations opens a climate conference in Copenhagen, aimed at winning agreement to reduce emissions. It also is aimed at prodding action next year on a climate bill, because the Obama administration has said it will move unilaterally if Congress fails to act.

Chrysler Dealers Ask for New Ads to Slow Sales Plunge

Chrysler Group LLC dealers have asked the company to pull new television ads and restore regional marketing budgets after U.S. sales declined 25 percent in November, people familiar with the matter said. Members of Chrysler’s national dealer council, an advisory body to the automaker, called for the ads to be stopped in a phone call with the Auburn Hills, Michigan-based company’s sales leadership this week ... The dealers would like to have Jeep, Chrysler and Dodge ads that show the vehicles more and highlight features, price and available bargains to counter marketing claims of other automakers, the people said.

Mr. Girsky, once a high-profile Morgan Stanley auto analyst who has been a member of the auto maker's board since the summer, last week was named a special adviser to Chairman and interim Chief Executive Edward E.
