Top 10 Lobbying Triumphs: Some Firms Won Big Despite Difficult Year in 2009

For some lobbyists, 2009 was a year for huge wins. K Street was supposed to be flat on its back. A deep recession meant corporate belt-tightening, and lobbyists were shamed month after month by an administration determined to limit their access. The White House stiff-armed lobbyists on the $787 billion stimulus package, then sought to block K Street from serving on influential federal advisory panels. But if some doors shut, others opened as Democrats pursued a sweeping legislative agenda. Healthcare, energy and financial regulation kept lobbyists working the halls. The efforts promised new challenges, but some companies and trade groups emerged as clear winners.

Auto dealers
All parts of the auto industry took a drubbing over the past year. But automobile dealers have found ways to win in Congress. The “Cash for Clunkers” program was a boost for dealers, while the lobby also won an exemption from the new Consumer Financial Protection Agency (CFPA). Just this month, the National Automobile Dealers Association (NADA) and Committee to Restore Dealers Rights successfully pushed Congress to pass a new arbitration system over how carmakers decide to close dealerships.

GM in Better Shape Than U.S. Expected, Obama Aide Says

General Motors Co. is finishing the year in a slightly stronger position than U.S. government officials expected and is on track to return to the stock markets in the second half of 2010, the Obama administration's top auto adviser said Thursday. The adviser, Ron Bloom, also said Chrysler Group LLC, despite losing market share, is also exceeding the administration's expectations, largely by rebuilding cash reserves, and that early signs point to a turnaround of the U.S. car industry. "The industry remains challenged but is in slow recovery," Mr. Bloom said in an interview at the Treasury Department. "It's coming back slowly, but it's coming back."

GM Will Shutter Saab After Talks Collapse

DETROIT -- General Motors Co. will shut down its Saab brand after announcing today that it could not conclude a deal to sell the Swedish automaker. GM Chairman and interim CEO Ed Whitacre warned earlier this week that it may close Saab. Spyker Cars N.V. was the possible buyer.

Ford, Geely Said to Make Progress Toward Volvo Sale

Ford Motor Co. is making progress toward a sale of its Volvo unit to Zhejiang Geely Holding Group Co. as they resolve issues such as protection of intellectual property... Directors of Dearborn, Michigan-based Ford were recently briefed on progress toward completing the sale to China’s Geely... Ford named Geely as its “preferred bidder” on Oct. 28. “We’re working with Geely toward an agreement that is in the best interests of all parties,” John Gardiner, a spokesman for Ford, said in a telephone interview. “No final decision has been made.” Other suitors are still interested in the Swedish premium brand known for passenger safety.

Tax Break Reminder: Only Days Left to Take Advantage of New Vehicle Sales Tax Deduction

Dealers are reminded that there are only a few days left in 2009 for car shoppers to take advantage of the new-vehicle sales tax or excise tax deduction. The Internal Revenue Service issued a reminder to taxpayers that they only have until Dec. 31. FTC Issues New 'Optional' Model Privacy Notice

As part of a statutory mandate to develop a more understandable template for privacy notices issued by dealers and other financial institutions, the Federal Trade Commission and the federal banking regulatory agencies have jointly issued a new model privacy notice that, beginning Dec. 31, 2009, will serve as a safe harbor for the language used in the notice for financial institutions that choose to adopt it. Dealers who continue to provide their finance and lease customers with a privacy notice that uses language from the sample clauses contained in Appendix A to the text of the original Privacy Rule (which required compliance by July 1, 2001) will lose safe harbor protection for the language used in those notices after Dec. 31, 2010. Accordingly, dealers should consider transitioning to the new notices before the end of 2010.
