S.B.A. Makes Small Businesses Bigger (the Easy Way)

On Wednesday, the Small Business Administration published a final rule revising upward the size standards that determine eligibility for S.B.A. programs in three broad sectors of the economy. And that is good news for nearly 18,000 businesses that until now have been unable to take a government-backed loan or to get assistance winning federal contracts. (Read more)

Editor's Note: Responding to a multi-year effort by NADA, the new 200-employee standard replaces one based on annual gross receipts of $29 million. Dealerships that fall below the size standard are eligible to apply for Small Business Administration loan guarantee programs, including 7(a) working capital loans, 504 real estate loans, or the new floor plan pilot program SBA intends to issue before year end. Note that the recently enacted Small Business Jobs Act set a new maximum alternative size standard of $15 million net worth and $5 million in net income (as measured over two years). A new-car dealer may qualify as a “small business” under either the 200 employee standard or this net worth/net income alternative.

High-speed reliance on gas irks critics; GM says drive system sets car apart from hybrids

Amid super-charged reviews, the 2011 Chevrolet Volt’s rollout to the press was marred by controversy Monday, as General Motors Co. had to fend off accusations that the extend-range vehicle isn’t really an electric car, but an over-hyped hybrid. New SPCC Compliance Date is Nov. 10, 2011

The U.S. Environmental Protection Agency (EPA) amended its Spill Prevention, Control and Countermeasure (SPCC) rules in 2008, providing dealerships with regulatory relief by creating a category of “Tier 1” qualified facilities eligible to complete a simple, self-certified SPCC plan template in lieu of a complex written SPCC plan. Tier 1 qualified facilities must have:

(1)  10,000 or fewer gallons in aggregate aboveground oil storage capacity and no individual oil storage container of more than 5,000 gallons, and
(2)  Looking back over the last three years, no discharge of oil to navigable waters exceeding 1,000 gallons, and no two discharges of oil to navigable waters within a 12-month period that each exceeded 42 gallons.
