NADA Urges Dealers to Meet with Members of Congress at Home During Upcoming Recesses

The upcoming congressional recesses this summer provide an ideal opportunity for dealers to meet with their members of Congress to discuss NADA's legislative priorities. The congressional recess schedule for the House and Senate is June 23 to July 5, and July 18 to September 6.

NADA Vice Chairman Mark Scarpelli (right), and president of Raymond Chevrolet and Kia in Antioch, Ill., hosts a visit with U.S. Rep. Randy Hultgren (R-Ill.) at the dealership on June 3, 2016.

Meetings with members of Congress at home – either at their district offices or at the dealership – go a long way toward supporting NADA's legislative efforts on Capitol Hill. Specifically, dealers should ask their Democratic Senators to support and vote for S. 2663, the "Reforming CFPB Indirect Auto Financing Guidance Act," which would require the CFPB to withdraw the flawed guidance that attempts to eliminate the ability of dealers to discount auto financing for consumers. For the Issue Brief and Myths vs. Facts sheet on S. 2663, click here.

Volkswagen will reportedly pay up to $7,000 apiece to owners of its diesel cars that were rigged to cheat U.S. emission standards under a $10 billion settlement that is scheduled to be submitted to a federal judge next week. The payouts will go to 482,000 owners of U.S. diesel vehicles on which the automaker installed software to skirt federal emission rules, according to Bloomberg News and the Associated Press, which cited unnamed sources.

FCA Accused of Concealing Defect in Jeep Grand Cherokee

Jeep Grand Cherokee owners filed suit in California against Fiat Chrysler, accusing the company of concealing and failing to fix a shifter design defect linked to driverless rollaway accidents, including the death this week of "Star Trek" actor Anton Yelchin. The class-action complaint, filed Thursday in U.S. District Court in Riverside, Calif., east of Los Angeles, alleges that the design flaw affects 811,000 vehicles, including 2014-15 model year Jeep Grand Cherokees, 2012-14 Chrysler 300s and 2012-14 Dodge Chargers. The lawsuit states that Fiat Chrysler Automobiles NV concealed both its shifter design defect and hundreds of related accidents that caused property damage and injuries.

Forecast: June Sales to Reach 11-Year High

Most automakers are expected to post year-over-year gains, resulting in a 2.5% improvement in the daily sales rate.

A WardsAuto forecast calls for U.S. automakers to deliver 1.57 million light vehicles this month. The expected daily sales rate of 60,314 over 26 selling days represents a 2.5% improvement from like-2015 (25 days), with total volume for the month rising 6.6%. The forecast 5.3% DSR decline from May (26 days) is slightly less than the 7-year average change for May-June. The report puts the seasonally adjusted annual rate of sales for the month at 17.3 million units, shy of last month’s 17.37 million SAAR, but ahead of the current 3-month SAAR (17.0 million) and the year-to-date SAAR through May (17.2 million).

Minnesota District Court Indicates Persuader Rule will be Overturned

On June 22, the Minnesota District Court denied the plaintiff’s request for a preliminary injunction in Labnet v U.S. Department of Labor. Nonetheless, the court did find that the persuader rule most likely violates the Labor Management Reporting and Disclosure Act (LMRDA). While the court’s decision doesn’t provide immediate and temporary relief, the ruling indicates that it will eventually overturn the rule.
