MLR Update

There has been a lot of exciting news regarding medical loss ratio (MLR) requirements during the past week, both in Washington and in the states. Regarding the federal legislation to amend PPACA and remove agent and broker commissions from the MLR, Representative John Barrow (D-GA) has publicly committed to introducing the bill with Representative Mike Rogers (R-MI). It is our hope that the bill will be formally introduced later this week, before the upcoming congressional recess. It will be one of only four bills to amend PPACA to be introduced thus far on a bipartisan basis. Expect a lot of grassroots activity on this legislation in the next few weeks, as we work towards getting a bipartisan Senate companion and additional House co-sponsors. Read More

No Federal Guidance on How to Create an Exchange Yet, But a Rule on How to Opt Out of One

The federal government doesn’t plan to give states comprehensive guidance as to what will constitute a federally approved health insurance exchange until late spring/early summer, but the administration has already come out with a proposed regulation on state waivers. On Friday, the Obama administration unveiled a proposed rule concerning Section 1332 waivers, which are also being called state innovation waivers. Read More

1099 Legislation—Still Floundering

Early last week there was hope that H.R. 4, the bipartisan bill to repeal the 1099 tax reporting requirements on businesses contained in PPACA, would actually see time on the Senate floor, especially after Senate Majority Leader Harry Reid (D-NV) voiced support for the bill on March 8. However, later in the week the bill lost steam as certain pro-reform groups like Families USA and certain unions began serious lobbying against the bill’s funding mechanism. Read More
