The co-chairs of the congressional “Supercommittee” tasked with coming up with $1.2 trillion towards deficit reduction as part of the Budget Control Act passed earlier this year have announced that the group has officially failed to reach its goal. Senator Patty Murray (D-WA) and Representative Jeb Hensarling (R-TX) announced in a joint statement this afternoon that the 12-member panel could not come to an agreement.  Read More

Delay on Summary of Benefits Implementation

On November 17, the federal Department of Labor issued guidance that delayed the effective date of PPACA's Summary of Benefits and Coverage and Uniform Glossary requirements. The guidance, issued via the Department’s webpage on frequently asked PPACA questions, did not give a new specific compliance date, but instead stated that until final rules are issued on this topic, group health plans and health insurance issues are not required to comply. The guidance went on to specify that once final rules are issued, the DOL anticipated that the new rules will include an applicability date that gives group health plans and health insurance issuers sufficient time to comply. Read More

HHS Delays Decision on Florida’s MLR Waiver Request

HHS announced last week that it will delay a decision on the MLR adjustment request submitted by the state of Florida by an additional 30 days. Florida Insurance Commissioner Kevin McCarty requested that HHS adjust its individual market medical loss ratio requirements almost a year ago. HHS was supposed to make a determination on the Florida request this month, but last week sent a letter to the commissioner extending their decision timeframe until December 16. Read More

Oregon Commissioner Heads to HHS

HHS announced last week that Oregon Insurance Commissioner Theresa Miller will be joining the staff of the Center for Consumer Information and Insurance Oversight (CIIO) as a special advisor to the center’s director, Steve Larsen. It’s anticipated that Commissioner Miller’s work will focus on the development of health benefit exchanges in the states and the federal fallback exchange for states that decline to establish their own exchange. She will start her new job on December 12. Read More

Supreme Court Gets Ready

The Temptations may have sung about getting ready first, but the Supremes are actually doing it, at least as far as the constitutional challenge to PPACA is concerned. Since announcing last week that the court will hear NFIB v. Sebelius, the case being brought by both the National Federation of Independent Businesses and 26 states to challenge the health reform law, during 2012, the U.S. Supreme Court has taken a few key steps to prepare. Read More
