HHS Releases New MLR Rules

On December 2, the federal Department of Health and Human Services (HHS) issued a final rule and an interim final rule addressing a variety of issues relative to the Patient Protection and Affordable Care Act’s (PPACA) medical loss ratio (MLR) requirements. The new regulations make no changes to the treatment of independent insurance agent and broker commissions and ignore the recommendation passed by the National Association of Insurance Commissioners on November 22 that the agency take whatever steps legally available to accommodate producer compensation in any final MLR rule. Read More

Upcoming House Small Business Committee Hearing on MLR Will Feature NAHU Member

The House Small Business Committee will hold a hearing about PPACA’s MLR requirements and the impact they have had on small employers nationally on December 15 at 10:00 a.m. EST. The hearing will feature testimony from Mitchell West, a NAHU member and agency owner from Colorado. Read More

Congress Working on Doc Fix and Keeping the Lights On

Congress has returned to Washington to face a number of looming deadlines, not least of which are the so-called “doc-fix” to prevent a 27.4% cut to Medicare physician reimbursements starting on January 1, 2012, and a continuing resolution to fund the government after December 16. Read More

New Rules Released to Increase Government Oversight of MEWAs

The Department of Labor's Employee Benefits Security Administration released two new proposed rules today to increase the level of federal oversight over multiple employer welfare arrangements (MEWAs).

Exchange Watch

Rumors continue to swirl both in Washington and in the states as to whether or not HHS actually has the funds to implement a federal exchange under PPACA and also if a federal exchange has the ability to offer exchange-based health insurance premium tax credits. Last week, Senator Orrin Hatch (R-UT), the ranking member of the Senate Finance Committee, sent a letter to Treasury Secretary Timothy Geithner and IRS Commissioner Douglas Shulman, warning that in his view the proposed rules on the premium assistance tax credits to be offered through the exchanges exceed statutory authority. Read More

HHS Finally Releases Information about PPACA’s Employer Wellness Program Grants

Remember those wellness plan grants that were included in PPACA and supposed to be rolled out in October 2010 but never were? Guess what? They are finally being rolled out! This is a link to an announcement in the Federal Register regarding the new National Healthy Worksite Program which is being rolled out by HHS and the Centers for Disease Control and Prevention (CDC). Interested employers are being asked to participate in informational webinars being held on December 20, January 13 and January 20. Interested employers should go to the program’s website and/or e-mail address to register for the webinars and/or be certified as an eligible employer. Read More

HHS to Launch Medicaid.Gov This Week

Later this week HHS plans to launch a new website, www.medicaid.gov to serve as a resource in understanding the Medicaid program and its state-by-state variations. The new site will include information on the state plan amendments, eligibility requirements, and covered populations currently in place. Read More
