The Latest Regulations—Cliff Notes Version
Last week, as a Thanksgiving treat, the Obama Administration issued a proposed rule addressing the definition of essential health benefits (“EHBs”) and the determination of actuarial value in the individual and small group markets. Notably for large group plans, the proposed rule provides some additional insight into the determination of whether plans meet the law’s minimum value standard. HHS also released a proposed rule on health insurance market reforms (including guaranteed issue requirements and application of new limits on premium rate bands); and the Internal Revenue Service (“IRS”), the Department of Labor’s Employee Benefits Security Administration (“EBSA”) and HHS’ Centers for Medicare and Medicaid Services (“CMS”) together issued a notice of proposed rulemaking on wellness programs in group health plans... Read More

Despite the fact that the re-election of President Obama secured the political future of the Patient Protection and Affordable Care Act (PPACA) and full repeal of the law is currently officially off the table, that doesn’t mean that the law’s future in the courts is clear. Clearly the people at CMS are having trouble reading our holiday wish list. When we put new reading material on there, we meant items like these.

They keep giving us things like formal requests for information on health plan quality requirements in exchanges. They’ve also sent proposed rules on the reinsurance requirements for the individual and small group markets over the Office of Management and Budget for final review, which means they could become public at anytime (our bet is this Friday afternoon)... Read More

Days of Our Exchanges
With the deadline for states to decide on their exchange plans extended to December, a number of states are still undecided as to what exchange model they will have. Opposition to exchanges, in some states, has continued despite the fact that exchanges, whether we like it or not, are here to stay.
