Sample Notice and FAQs for EEOC Wellness Regs

This week, the Equal Employment Opportunity Commission (EEOC) released a new set of FAQs on its wellness notice along with a sample notice for employers, which accompany the final rule for employer-sponsored wellness programs that was published on May 17. The new requirements for employer-sponsored wellness programs necessitate compliance changes for many existing wellness programs beginning during the 2017 plan year. NAHU’s summary of the new rule can be found here. The rules require employers that offer wellness programs that collect employee health information to provide a notice to employees informing them what information will be collected, how it will be used, who will receive it, and what will be done to keep it confidential. The FAQs clarify that the notice to employees may be provided electronically and is effective the first day of the plan year that begins on or after January 1, 2017.
