Abandoned Property Bill Headed to Governor's Desk

Last week the New Jersey General Assembly passed a bill that created a summary foreclosure process for abandoned properties by a vote of 79-0.  This bi-partisan bill already passed the Senate by a lopsided vote of 35-2.

The bill creates a summary action to foreclose when a residential property is deemed vacant and abandoned.  Under the bill, the lien holder may make an application to the court, at any time in the process, for a declaration that the property is vacant and abandoned.  The bill lists 15 criteria for the court to make such a determination and requires that at least two of the 15 elements are present.  Properties under construction or renovation cannot be deemed vacant under this bill.  Upon proper service of process, the court may rule by clear and convincing evidence that a property is abandoned.  The property will then proceed to sheriff sale in 60 days.   Read more

OCC Issues Guidance on Stress Testing

The OCC guidance reinforces that community banks, regardless of size, should have the capacity to analyze the potential impact of adverse outcomes on their financial conditions. The guidance details types of stress test methods that banks can use and provides an example of a simple stress test framework to consider.   Read more
