CFPB Proposal Amends Reg Z and Provides Ability-to-Repay/QM Rule Exemptions

The final rule implements sections of the Dodd-Frank Act which generally require creditors to make a reasonable, good faith determination of a consumer’s ability to repay any consumer credit transaction secured by a dwelling (excluding an open-end credit plan, timeshare plan, reverse mortgage, or temporary loan) and establishes certain protections from liability under this requirement for “qualified mortgages.” In addition, the CFPB has issued a proposal concurrent with the ability-to-repay/qualified mortgage final rule that would provide smaller portfolio lenders with exemptions from that regulation. The proposal would provide relief to institutions with total assets of $2 billion or less that originate fewer than 500 mortgage loans per year and hold them in portfolio. Comments must be received on or before February 25, 2013.   Read more
