Agencies Publish Final Rule on Appraisals for Higher Priced Mortgage Loans

For mortgages with an annual percentage rate that exceeds the average prime rate offer by a specified percentage, the final rule requires creditors to obtain an appraisal or appraisals meeting specified standards, provide applicants with a notification regarding the use of the appraisals, and give applicants a copy of the written appraisals used.   Read more

CFPB Publishes Final Rules for Amendments to Regulations Z and X

Amendments to Reg Z place restrictions on loan originator compensation, including application of these restrictions to prohibitions on dual compensation and compensation based on a term of a transaction or a proxy for a term of a transaction, and to recordkeeping requirements. The final rule also establishes tests for when loan originators can be compensated through certain profits-based compensation arrangements.

The final rule addresses servicers' obligations to correct errors by mortgage loan borrowers; to provide information requested by borrowers; and to provide protections to borrowers in connection with force-placed insurance.

The final rule also addresses servicers' obligations to establish policies and procedures to provide information about mortgage loss mitigation options to delinquent borrowers; to establish policies and procedures for providing delinquent borrowers with continuity of contact with servicer personnel; and to evaluate borrowers' applications for available loss mitigation options.    Read more

CFPB Provides Plan for Implementation of New Mortgage Rules

The Consumer Financial Protection Bureau (CFPB) announced a plan that will focus on the mortgage industry’s compliance with new consumer protections that go into effect in January 2014.

Among the new mortgage rules is the Ability to Repay rule which, according to the CFPB protects consumers from irresponsible mortgage lending by requiring lenders to make reasonable, good faith determinations that prospective borrowers have the ability to repay their mortgage. The rule is also designed to protect borrowers from lending practices such as underwriting loans based only on low introductory “teaser” interest rates.

In addition, new mortgage servicing rules have been established to protect homeowners. Other new rules address appraisals, escrow accounts, protections for high-cost mortgages, and compensation and qualifications for loan originators.   Read more

FASB Proposes Improvements to Recognition and Measurement of Financial Assets and Liabilities

The Financial Accounting Standards Board (FASB) has issued a proposal which provides a measurement framework for classifying and measuring financial instruments. According to FASB, it developed Proposed Accounting Standards Update, Financial Instruments—Overall: Recognition and Measurement of Financial Assets and Financial Liabilities, as part of its joint project with the International Accounting Standards Board (IASB) to improve and converge the accounting for financial instruments. Comments on the proposal are due by May 15, 2013.   Read more
