Abandoned Property Law Effective Next Week

Next week, a law that creates a summary foreclosure process for abandoned properties will go into effect.

The law creates a summary action to foreclose when a residential property is deemed vacant and abandoned. Under the law, the lien holder may make an application to the court, at any time in the process, for a declaration that the property is vacant and abandoned. The law lists 15 criterion for the court to make such a determination and requires that at least two of the 15 elements are present. Properties under construction or renovation cannot be deemed vacant under this law. Upon proper service of process, the court may rule by clear and convincing evidence that a property is abandoned. The property will then proceed to sheriff sale in 60 days.    Read more

CFPB Finalizes Changes in ATM Disclosure Rule

ATM operators will now only have to provide the on-screen or paper disclosure which includes the amount of the fee to be charged and is provided before the consumer is committed to the transaction.   Read more
