ABA Urges Bankers to Sign Reg Relief Petition and Call and Tweet Senators for #RegRelief Action

The ABA is urging all bankers to sign its petition for regulatory relief for America’s hometown banks. With just days remaining before a government spending bill is due, signing the petition is the banking industry’s best chance for attaching reg relief provisions. Click here to sign the petition now. Negotiations are also going on this week over including financial regulatory relief provisions in the government spending bill due next week, and ABA is urgently calling on bankers to call and tweet their senators to build support for the industry’s reg relief priorities. Attaching the ABA-backed measures to the spending bill, due by Dec. 11, is considered the best chance for getting reg relief passed this year.  Access the Senate phone directory. Compliance Briefings Look to Year Ahead
To help compliance officers get a head start on preparing for the new year, ABA is offering two compliance-related briefings in December. On Dec. 10, a banker-led briefing will focus on developing an effective first line of defense for compliance risk management. On Dec. 15, ABA’s compliance experts will discuss managing 2016 compliance priorities, including anti-money laundering, HMDA, fair lending, military lending, UDAAP, flood insurance and more. CFPB Clarifies Requirements for EFT Preauthorization
The Consumer Financial Protection Bureau yesterday issued a bulletin clarifying the obligations of entities obtaining customer authorization for preauthorized electronic funds transfers. To be compliant, all EFTs must be authorized by the customer in writing -- in either paper or electronic form, as specified by the E-Sign Act -- and the customer must be provided with a copy of the authorization terms that includes the timing and amount of the recurring transfers.

Fed Issues Final Rule on Emergency Lending
The Federal Reserve Board yesterday issued a final rule, as required by the Dodd-Frank Act, specifying procedures and requirements for emergency lending under the Federal Reserve Act. The rule clarifies the definition of “broad-based eligibility” for programs and facilities providing emergency loans, and expands the definition of “insolvency” to include borrowers who fail to pay undisputed debts in the 90 days prior to borrowing.

Sheriff Sale Taking too Long – Try This
In virtually all foreclosure cases, the real property at issue is sold by a sheriff after a foreclosure judgment is entered and a writ of execution issued. There is, however, a little known, and more rarely used, alternative that may be available to effectuate a sale of particularly vulnerable properties prior to entry of a final foreclosure judgment, pendente lite, in other words, while the foreclosure litigation is pending.

Federal Home Loan Bank of New York Declares a 4.10% Dividend for the Third Quarter of 2015

The Federal Home Loan Bank of New York announced that, on November 19, 2015, FHLBNY's Board of Directors approved a dividend for the third quarter of 2015 of 4.10% (annualized). The dollar amount of the dividend will be approximately $54.5 million. The cash dividend will be distributed on November 20, 2015.
