The guy who likes his chicken fried, a cold beer on a Friday night, jeans that fit just right and the radio on just elected a President.  The images of the Zac Brown Band song are what blared through as returns came in.  Donald Trump was elected President to the shock and chagrin of the media, the Establishment and the Democratic Party.  The Hillary Clinton Coalition was not the Barack Obama Coalition, in fact in key Democratic areas in Pennsylvania and Michigan, Clinton significantly underperformed President Obama among white male voters.  The narrative of racism and “deplorables” as well as crossover Republican women did not hold true.  At the end of the day, something beats nothing and the Democrats could not articulate a program to offer a different choice than the program offered by Mr. Trump.  Mr. Trump had a program and a vision.  He won. Americans with Disabilities Act and Website Accessibility Standards: Practical Information You Need Now Briefing

The ADA’s obligations cover all financial institutions regardless of their size. This ninety-minute briefing/webcast will provide insight into important legal compliance issues facing the banking industry today when it comes to doing business with individuals with disabilities. Are your bank’s websites, Internet banking services accessible to the visually impaired?
Banks of all sizes nationwide are receiving demand letters from plaintiffs’ law firms on behalf of visually impaired customers alleging inability to access Internet banking websites in violation of the Americans with Disabilities Act (ADA). The letters demand that the banks modify their websites to comply with proposed rules that won’t be enacted until 2018 and, of course, the firms are seeking attorneys’ fees.

FFIEC Finalizes New Consumer Compliance Rating System
The Federal Financial Institutions Examination Council finalized its new uniform interagency consumer compliance rating system, intended to reflect changes in consumer compliance supervision since the current system was introduced in 1980. The final system was adopted substantially as proposed with a few points of clarification. The new system will begin to be used by FFIEC member agencies for examinations beginning on or after March 31, 2017.

AML ‘Special Measure’ Imposed on North Korea by FinCEN
The Financial Crimes Enforcement Network has issued a final rule imposing a special measure against North Korea as a jurisdiction of primary money laundering concern under the USA Patriot Act. The rule prohibits U.S. financial institutions from opening or maintaining a correspondent account on behalf of a North Korean financial institution, prohibits U.S. FIs from processing transactions involving North Korean FIs and requires special due diligence measures.

Fed Senior Loan Officer Survey: CRE Loan Standards Tighten; C&I Holds Steady
Bankers continued tightening credit for commercial real estate loans in the last three months while holding steady on other business loans and consumer loans and easing credit standards slightly in their home mortgage portfolios, according to the Federal Reserve’s latest senior loan officer survey.

Agencies to Host Free Webinar on Updates to CRA Q&As
On Nov. 29, the federal banking agencies will host a free webinar to answer questions about recent changes to the interagency Community Reinvestment Act question and answers. The changes, announced in July, focus primarily on alternative delivery of retail banking services, innovative or flexible lending practices, qualified investments and community development. FinCEN Final Rule Makes Technical BSA Amendments
The Financial Crimes Enforcement Network has made several technical amendments to its regulations implementing the Bank Secrecy Act. The changes are intended to remove references to obsolete BSA forms, outdated recordkeeping technologies and other out-of-date terms.

CFPB Clarifies ‘Flexibility’ in Third-Party Risk Management
The Consumer Financial Protection Bureau has issued an update to its guidance on risk management for third-party service providers. The update is intended to clarify that entities supervised by the bureau have “flexibility” to “allow appropriate risk management” of these relationships.

OCC Discloses Data Breach
In a notification to Congress of a “major information security incident” as required by federal law, the OCC released that a former OCC employee downloaded at least 10,000 encrypted files onto two thumb drives, took them off the premises and has not returned them to the agency. “Based upon currently available information, there is no evidence to suggest that any non-public OCC information, including any personally identifiable information or controlled unclassified information has been disclosed to any member of the public or misused in any way,” the agency said.
