NJBankers Heads to Washington to Meet with Regulators
NJBankers Chairman William D. Moss, president/CEO of Two River Community Bank led a delegation of 16 NJBankers members to Washington, DC, for the NJBankers annual regulatory visit. Our group consisted of NJBankers President/CEO John McWeeney, Jr., Mike Affuso, NJBankers EVP/Director of Government Relations, nine CEOs and other senior officers from their respective banks. After a joint regulatory briefing by the staffs of ABA and ICBA, over a 24 hour period our group met with representatives from the CFPB, OCC, FHFA, Federal Reserve, FinCEN and FDIC. We had a productive dialogue with the regulators on a variety of issues that included CRA Modernization, Cannabis Banking and BSA just to name a few. The tone of the meetings were very collaborative, noticeably better than in past years. The group also enjoyed a wonderful evening of dinner and networking at Morton’s Steakhouse. Thanks to our sponsors- the Community Bankers Association, ICBA and Riker Danzig for their support of our DC visit. A special thank you to our members who participated which included 1st Bank of Sea Isle City, Columbia Bank, Haddon Savings Bank, Lakeland Bank, Magyar Bank, Northfield Bank, OceanFirst Bank, Provident Bank, Roselle Bank, Somerset Savings Bank, Two River Community Bank, Unity Bank and Valley National Bank.

Federal Reserve Bank of New York Business Leaders Survey
Activity in the region’s service sector expanded strongly, according to firms responding to the Federal Reserve Bank of New York’s September 2018 Business Leaders Survey. The survey’s headline business activity index climbed eight points to 22.5, its highest level in more than ten years. The business climate index reached a record high of 23.2, a sign that firms, on balance, regarded the business climate as better than normal.

NACHA Greenlights Same-Day ACH Enhancements

NACHA has approved three new rules that will expand the capabilities of same-day ACH for banks and bank customers, including expanded hours and a higher per-transaction dollar limit.

Clarida Sworn in as Fed Vice Chairman
Richard Clarida was sworn in yesterday to a four-year term as vice chairman of the Federal Reserve board. With Clarida’s confirmation, three vacancies remain on the board. 

Federal Reserve Board approves final amendments to liability provisions of Regulation CC
The Federal Reserve has approved final amendments to the liability provisions of Regulation CC. These amendments continue the Board's efforts to update Regulation CC to reflect the evolution of the nation's check collection system from one that is largely paper-based to one that is virtually all electronic.

FDIC Releases Results of Summary of Deposits Survey
The Federal Deposit Insurance Corporation (FDIC) has released the results of its annual survey of branch office deposits for all FDIC-insured institutions. The latest data are as of June 30, 2018.

FDIC Seeks Comment on the Treatment of Reciprocal Deposits
The FDIC is seeking comments on a proposed rule to implement Section 202 of the Economic Growth, Regulatory Relief, and Consumer Protection Act (EGRRCPA) to exempt certain reciprocal deposits from being considered as brokered deposits for certain insured institutions. Under the reciprocal deposit exception addressed in the proposed rule, well-capitalized and well rated institutions are not required to treat reciprocal deposits as brokered deposits up to the lesser of 20 percent of its total liabilities or $5 billion.

Five Agencies Issue Statement Reaffirming the Role of Supervisory Guidance
The statement regarding the role of Supervisory Guidance from the Fed, CFPB,  FDIC, OCC, and NCUA confirms that supervisory guidance does not have the force and effect of law, and the agencies do not take enforcement actions based on supervisory guidance.

Fed Beige Book: Economy Continues to Expand at a Moderate Pace 
The economy continued to grow across the Federal Reserve districts at a moderate pace through the end of August, the Federal Reserve reported in its sixth Beige Book release of 2018. Consumer spending grew at a modest pace across all districts. Most districts reported softer existing home sales growth, while home construction was up modestly on balance. Commercial real estate construction was mixed.  

Debit Card Use, Market Penetration Rises in 2017, Survey Finds
Debit card use and market penetration continued to grow in 2017, while fraud losses declined, according to Pulse’s debit issuer survey released yesterday. The rate of checking accounts with associated debit cards ticked up one point to 76 percent, while the share of debit cards used at least once per month rose one point to 66 percent. Active debit card users on average made 23.7 purchases per month, up from 22.9 in 2016.

OCC Issues Advance Notice of Public Rulemaking (ANPR) for reforming CRA Regulatory Framework

The ANPR that the OCC issued on August 28th provides banks with an opportunity to weigh in on how to update and modernize CRA. This ANPR is not just for OCC member banks, but for all institutions regardless of your charter type. Responses are due 75 days after publication in the Federal Register. The ANPR consists of 31 different questions. You can answer all of the questions or just the ones you care to comment on. It’s critical that you provide your feedback so please ensure that your institution responds.

Peapack-Gladstone Bank Announces Promotion and Hire
Dennis R. Magarro was promoted to Senior Vice President, Senior Underwriter at Peapack Capital, a subsidiary of Peapack-Gladstone Bank.  Dennis is responsible for credit and underwriting functions at Peapack Capital which focuses on equipment finance and leasing.  The Bank also announced the appointment of June Ryan, Senior Managing Director & Senior Trust Officer, Peapack Private Wealth Management. 

Tri-State becomes SB One Insurance Agency
The change follows the rebranding of SB One Bancorp and SB One Bank earlier this year.

It is with sadness that we report the passing of Peter Barnes Jr., a director at Metuchen Savings Bank for many years. Peter Joseph Barnes Jr. of Edison New Jersey died on Tuesday, September 11, 2018 one day shy of his 90th Birthday. Born September 12, 1928 in Providence, Rhode Island, Peter was the sixth of seven children born to Charlotte (née Walsh) and Peter J. Barnes, Sr.
